Tax Deed Sales
Texas property tax sales
could be classified as a hybrid
between tax deeds and tax lien
certificates. Texas is
classified as a tax deed state,
meaning that if property owners
fail to pay their taxes their
properties are lost through the
legal process of tax
foreclosure.
Any legal taxing jurisdiction
can foreclose on property.
Consequently, school districts,
counties or towns can force the
process of tax foreclosure.
Tax sales are handled by law
firms for each county. Sheriffs
or constables are responsible
for actually conducting the
auctions.
After sales are conducted,
owners still have six months to
redeem their properties (two
years for homestead or
agriculture property). In
the case of redemption, the
owner must satisfy the debt by
paying the taxes and cost due
plus interest. An owner must pay
a purchaser the purchase price
plus 25 percent interest on the
six months. For homestead or
agriculture property, the
interest rate is 25 percent the
first year and 50 percent the
second year.
